Draft for owner and legal review, revised 7 October 2026. Version data-terms-draft-2026-10-07-v3. Licence data-licence-draft-2026-10-07.

Read the 1 October 2026 draft terms and licence or the earlier 7 October 2026 draft or the service-address revision. The version accepted with an existing order remains applicable to that order.

These proposed terms are not an approved production agreement. The service commitments below are proposed for the paid launch. Checkout in this preview, if enabled, uses Stripe test mode only.

1. Who the service is for

FuelWatch Data & Reports is provided by Alex Santos, trading as FuelWatch.ie, with service address Lodge Road, Westport, Co. Mayo, Ireland. Contact hello@fuelwatch.ie for orders, support, complaints or privacy requests.

These terms cover purchases for a business, profession or public body. By ordering, you confirm that you have authority to act for the billing organization. These product terms govern Data & Reports purchases; using the consumer app does not require a business subscription. Nothing here removes any mandatory rights that apply if a purchaser is legally a consumer.

2. What you purchase

Your order records the product, dataset, reporting period or cutoff, lookback window, included fields, release identifier, method version, quality result and total fee shown before checkout. One-off purchases license the selected release. Historical benchmark purchases cover one completed calendar month and one fuel benchmark. Station snapshots cover Republic of Ireland petrol and diesel at one selected cutoff within a bounded observation window.

Monthly Monitor is €149 per month for one national benchmark and monthly reporting. Fortnightly Monitor is €250 per month for one national benchmark, reports every 14 days, calendar-month views and a consumption calculator. Historical benchmark downloads are €99 once; station snapshots are €299 once. Service fees are in EUR. FuelWatch is not VAT-registered and does not add VAT to these fees. The tax basis of fuel observations is a separate field in each report.

Only products and releases marked available can be purchased. The fixed free sample is synthetic and shows file structure; the coverage displayed for your selected release describes what that purchase includes.

3. Your licence

The billing organization receives a non-exclusive licence to use its paid releases for internal business analysis, budgeting, procurement and reporting. It may share aggregate findings with clients, collectors or other stakeholders, including in business reports, with the source, period and limitations made clear. Aggregate findings must not substitute for distributing the underlying dataset.

Raw dataset redistribution, resale and public product integration require separate written permission where FuelWatch controls those rights. No restriction here removes rights granted under an applicable third-party open licence. Preserve the source attribution, notices and licence obligations identified in the release. These terms do not grant rights to a source or field that the release excludes.

Company recipients must verify their email, and access requires authorized organization membership and the exact release entitlement. Keep sign-in and download links private. The organization owner can remove recipients. A removed recipient must stop using organization-licensed files unless the organization separately authorizes that use within this licence.

The organization may continue using lawfully downloaded releases after a subscription ends. That licence has no fixed expiry, subject to these terms and any valid refund, rights restriction or termination for a material licence breach. Hosted library access is described in section 7.

4. Subscriptions and cancellation

Subscriptions renew monthly until cancelled. The opening report is the specific completed release reviewed at sign-up. Future releases are included when their release access window falls within the paid subscription period. A subscription does not unlock the complete pre-subscription archive. Monthly billing and the anchored 14-day reporting calendar are independent; the next reporting date is displayed before purchase.

Cancel through the Stripe customer portal before the next renewal. Cancellation takes effect at the end of the paid period. A failed renewal grants no new paid period; successful payment recovery restores the access supported by that payment. Cancellation does not remove previously licensed releases from the library during the access period in section 7.

A business customer changing its mind after a one-off release is supplied, or cancelling partway through a correctly supplied subscription period, does not ordinarily receive a refund for that release or elapsed paid period. This does not affect the remedies in section 6 or any mandatory cancellation or refund right.

5. What the reports can tell you

We will prepare and supply reports with reasonable skill, care and diligence, using the methodology and quality checks stated for the release. Reports describe sampled observations and quotations. They are not transaction prices, an official index, a complete market survey, a promise of availability or a guarantee of the price a buyer will pay.

Sources may include community price reports, public registers and supplier website quotations. Collection can use periodic automated checks of public pages and quote forms. A public source is not automatically open-licensed: inclusion depends on a documented basis for the selected facts, fields and use, which may be an applicable licence or another established lawful basis. These terms do not grant rights over a supplier's website or imply its endorsement.

Report files exclude contributor names, emails, account identifiers, photographs, device-location records and activity histories. Station or supplier business names, prices and observation times may be included. The privacy policy explains linked source records and why removing direct identifiers is not, by itself, a guarantee of anonymity.

Geographic applicability does not equal independent observation count. Review the release’s freshness, omissions, included fields, source labels, tax basis and methodology before using it. Unknown values remain unknown. A recorded verification flag does not by itself mean independent verification.

Products with unresolved source rights, measurement basis or a failed quality gate are withheld. We do not replace missing observations with invented prices. You remain responsible for checking that the disclosed scope suits your purpose and for procurement or other decisions made using the report. This does not excuse a failure to supply the report as described.

6. Delivery, corrections and refunds

Files become available in the private report library after server-confirmed payment. Email notifications go to verified recipients. A missing or delayed email does not remove authorized library access. If you cannot obtain the purchased file, contact us with the order reference.

Corrections create a linked new version and a notice; they do not silently replace the file originally purchased. We will explain material corrections or a scheduled report being withheld. Where a rights or security issue requires immediate suspension, we may restrict the affected release while we investigate, explain the restriction and provide the appropriate remedy below.

Report a missing release or material error to hello@fuelwatch.ie. We aim to acknowledge it within two working days and correct it without charge within ten working days of receiving enough information to investigate. Working days are Monday to Friday, excluding Irish public holidays. These targets do not extend any shorter legal deadline.

If we cannot supply a usable release matching the agreed scope within that correction period, you may choose an agreed later correction or a refund. A one-off purchase that cannot be supplied as described receives a full refund. For a partly useful release, you may agree a proportionate price reduction instead. A subscription refund covers the part of the paid service not supplied as agreed; if none of that paid period’s service is supplied, we refund that period in full. You can end the affected subscription immediately if the failure is material or repeated. A serious issue that cannot be corrected does not require you to wait for the correction period.

We will issue refunds within 14 calendar days after they become due, using the original payment method unless you agree otherwise, without a refund fee. A credit is offered only with your agreement. Payment-provider processing can affect when funds appear in your account. For an unresolved ongoing failure, we will stop further charges for the affected subscription until a resumption is agreed.

A full refund ends the FuelWatch-controlled licence for the refunded release; stop using those licensed contents. Third-party open-licence rights remain intact. A payment dispute may temporarily suspend the related access. If the payment is upheld in FuelWatch’s favour and no other restriction applies, the access is restored. A partial refund does not by itself cancel the whole release licence. These payment-related restrictions do not affect unrelated purchases. No complaint deadline in these terms shortens a statutory right.

7. Library access and records

We will provide private library access to each paid release for at least 24 months from the date it is first licensed to your organization, including after subscription cancellation. Save the files you need for longer use. After that minimum period, we will give at least 90 days’ notice before a planned withdrawal of hosted access. Lawful downloaded use continues under section 3. Immediate restrictions for a refund, dispute, material licence breach, legal requirement or security issue follow section 6 where applicable.

We retain the minimum order, payment and tax records needed for our obligations, ordinarily for six years from the relevant transaction, or longer where a specific legal obligation or an unresolved claim requires it. Release and entitlement records support the promised access, corrections and proof of licence. This does not mean that every email, delivery log or account detail is kept for six years.

Business contact and access details are kept while needed to run the account and provide licensed access. We review other personal records at least annually and remove or anonymise information that is no longer needed. On an account-deletion request, we remove unnecessary contact and access details within 30 days, while retaining only the limited records needed for legal obligations or unresolved claims. Download required files and arrange any organization-owner transfer before closing an account.

The FuelWatch privacy policy explains personal-data rights and contact details. This section adds the retention criteria for paid business reports. It does not limit rights under data-protection law.

8. Responsibility and liability

Subject to the safeguards below, FuelWatch is responsible for reasonably foreseeable direct loss caused by its breach of these terms or failure to exercise reasonable care. For business purchases, total liability for a claim or connected claims is limited to the greater of €1,000 or the fees paid for the affected product in the 12 months before the event giving rise to the claim.

We do not accept liability for indirect or consequential loss, including lost profit or anticipated savings where that loss is indirect or consequential. This does not turn an otherwise recoverable direct loss into an excluded loss merely because it concerns money spent on fuel.

The limit does not reduce refunds or credits due under section 6. Nothing here excludes or limits fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Mandatory consumer and data-protection rights remain unaffected.

9. Changes and disputes

The accepted terms and licence version apply to your order. We will not retrospectively reduce rights in an already licensed release. Material changes affecting a future subscription renewal will be notified at least 30 days before they take effect, with the option to cancel before the first affected charge.

Please contact hello@fuelwatch.ie so we can investigate a complaint. These terms are governed by Irish law, and the courts of Ireland have jurisdiction, subject to any mandatory right to use another court. If a provision cannot be enforced, the remaining provisions continue so far as the law allows.
